The NBL Board of Directors met last night and, after a lengthy discussion, decided to deny Mike Day's appeal to get the points back that he lost in Evansville.  The Board cited a specific rule in the NBL rulebook stating that riders could not receive points with an invalid license.  Jerry Bradford, who was helping Day with the appeal, felt that the Board's decision, although following the letter of the law, did not follow the spirit of the law. 

Day won Sunday's Elite Men's main event at the NBL's Hoosier National in Evansville, Indiana in June.  Apparently, his license expired at midnight the night before.  Day's contention was that the NBL should not have signed him up knowing that his license would not be valid on Sunday.  NBL officials cited similar cases, specifically, Neal Wood, Matt Pohlkamp, and Kyle Bennett, where riders' points were taken away for expired licenses.  Day's case differed because in those cases, the riders were warned about their licenses expiring and allegedly no steps were taken to correct the problem.  Day was given no such warning and when it was brought up, he immediately paid his membership fees.   Day was allowed to keep his winnings for his Sunday Evansville win, however.   According to Bradford, an unofficial vote was taken of the NBL's top ten Elite Men, and the majority was in favor of restoring Day's points.   Apparently the NBL Board did not feel the same.  Neither Day nor NBL rider representative Jason Richardson, could be reached for comment.
